    The Kerala High Court has ruled that the State Government can maintain an admiralty suit in connection with the sinking of the container vessel MSC Elsa 3, which went down off the state’s coast earlier this year.

    The Court clarified that the State has sufficient standing to pursue claims for environmental and economic damages arising from the maritime casualty. However, in a significant relief for the shipping line, the Bench slashed the quantum of security required for the release of the arrested sister vessel from Kochi Port.

    Legal experts say the judgment balances the State’s right to seek compensation while preventing excessive hardship to shipowners. The case is expected to set a precedent for government-initiated admiralty actions in Indian courts.
